Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and related services provided by Otherworld Interactive, Inc. (“Otherworld,” “we,” “us,” or “our”), collectively the “Service.” By using the Service, you agree to these Terms.
Eligibility
You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian who agrees to these Terms. You must be legally capable of entering into this agreement.
Accounts
You are responsible for providing accurate account information, maintaining the security of your account, and all activity under your account. Notify us promptly if you believe your account has been compromised. You may not transfer or sell your account.
Your content
You retain ownership of the original content you submit to the Service. You grant Otherworld a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, process, display, and distribute your content only as needed to operate, improve, secure, and promote the Service and to make content available according to the sharing or publishing choices you make.
You represent that you have the rights needed to submit your content and that it does not violate law, intellectual-property rights, privacy rights, or these Terms. You are responsible for reviewing generated content before relying on, publishing, or sharing it.
Generated content
The Service uses artificial intelligence to produce story text, images, and other material. Generated content may be inaccurate, incomplete, offensive, or similar to content produced for others. Otherworld does not guarantee that generated content is unique, factually correct, or suitable for any particular purpose. You must not rely on the Service for medical, legal, financial, or other professional advice.
Acceptable use
You may not misuse the Service, interfere with its operation, attempt unauthorized access, evade usage or payment limits, distribute malware, harass or exploit others, impersonate others, violate law, infringe rights, or use the Service to create or distribute illegal content. You may not use automated means to scrape the Service or reverse engineer it except where applicable law expressly permits.
Purchases, subscriptions, and virtual items
Prices and purchase terms are shown before payment. Taxes may apply. Unless otherwise stated or required by law, purchases are final and non-refundable. Subscriptions renew at the disclosed interval until canceled and remain available through the end of the paid period after cancellation. Credits or other virtual items are licensed, not sold; have no cash value; are non-transferable; and may be modified or discontinued subject to applicable law.
Third-party services
The Service relies on third-party platforms and may link to third-party services. Their terms and privacy practices govern your use of those services. Otherworld is not responsible for third-party services outside our control.
Service changes and termination
We may modify, suspend, or discontinue all or part of the Service. We may restrict or terminate access if you violate these Terms, create risk or legal exposure, or misuse the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” OTHERWORLD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OTHERWORLD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY ARISING FROM THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID OTHERWORLD DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Otherworld and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses arising from your content, your misuse of the Service, or your violation of these Terms or another person’s rights.
Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute not subject to a legally required alternative process will be brought in a court of competent jurisdiction in California, and you and Otherworld consent to personal jurisdiction there. Nothing in these Terms limits rights you may have under mandatory consumer-protection law.
Changes to these Terms
We may update these Terms. We will post the revised Terms and update the effective date. If a change is material, we will provide additional notice when appropriate. Continued use after the revised Terms take effect constitutes acceptance.
